America: The Idea Examining the Intent of the Constitution

At one time, America was simply an idea. People escaping the oppression of England were heading to a new life in a new world. The “idea” was freedom and equality. Later on, along those same lines of thinking a constitution was drafted and its first words bring that idea to the fore.

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness”

Have we forgotten the dream?

Each time a legislature passes a law that is, in its face, contrary to the “idea” it shows, we have forgotten. Each time lawyers stand to defend such laws, it shows, we have forgotten. Each time the public turns a blind eye to the losses of freedom, it shows, we have forgotten.

Laws such as the Patriot Act, the AWA and the registries which require people to register to like animals, forced homelessness through residency restriction and employment restrictions that lead to unemployment and travel restriction that trap people in this country, all of which on their face appear to protect the public, but do not. In reality these laws strip the constitutional ly mandated freedoms in the name of safety and they are an affront to the “idea of America.”

When we read the above words do we miss their meaning? Let’s look at the meaning of those words in the light of the “idea of America.”

Self-evident: Clear, Obvious. Do we see clarity in the laws that are now being passed. In most cases these laws are passed on faulty claims, false evidence or inaccurate studies.

Created Equal: Created Identical. Can this equality be removed? Current law says it can.

Unalienable Rights or Inalienable Rights: UNCHALLENGABLE, ABSOLUTE, IMMUTABLE, UNASALABLE, UNDENIABLE.

Many of our current laws do not stack up to the definitions of what the founders of this nation had envisioned. The “idea of America” does not allow for people to forfeit their rights under any circumstances. These rights include Life, Liberty and the Pursuit of Happiness.

We understand life, but what about Liberty? Freedom, independence, liberation, emancipation.

And what about Happiness? Contentment, joy, bliss.

Do the above mentioned laws bring about Liberty of Happiness?

No, they bring about oppression and oppression is the exact opposite of the “idea of America.”

These laws bring about the shrinking of freedom. Some of these laws effect all American’s and others just some. But the overall effect is that the “idea” of a free nation is being eroded in much the same way the preamble of our constitution describes the oppression of the English king.

Lawmakers who push these laws in the name of security and public safety are nothing more than vote whores. They have forgotten the “idea of America”.

Remember, according to the opening words of the constitution no one can forfeit their unalienable rights. And yet they have been seized in the name of modern government.

Personally I would like to see this issue to be presented before the U.S. Supreme Court and a ruling on these words as they apply to all American’s. In the true light of the “idea of America” the court would have to find that lawmakers cannot remove these rights from anyone and the above laws are unconstitution al from the very first words of the founding document of this nation.
